BIGYES - USER AGREEMENT (TERMS OF USE)

BIGYES is a digital platform designed to enhance guest engagement for hotels and cafés by offering interactive tools, promotional offers, feedback collection, and communication features. This User Agreement governs your access and use of the BIGYES application and its related services.

You must be at least 18 years old to use BIGYES. By using the Application, you confirm that you meet this requirement.

To access certain features, you may need to create an account. You agree to provide accurate and truthful information. You are responsible for maintaining the confidentiality of your login credentials. BIGYES is not liable for unauthorized access due to your failure to secure your account information.

Users agree to use BIGYES only for lawful purposes and in compliance with this Agreement. You may NOT: • Copy, modify, distribute, or reverse-engineer any part of the application. • Use BIGYES to harm, threaten, or mislead others. • Interfere with the Application's security features or operations.

BIGYES may include features such as: • Interactive reward systems (e.g., prize wheel) • Customer feedback tools • Promotional offers and advertisements • Access to hotel/café services and maps • Communication or notification functions BIGYES reserves the right to update, modify, or remove any feature at any time.

Some content, offers, or features may be provided by third-party hotels, cafés, or service partners. BIGYES is not responsible for: • Partner-provided services • Pricing or availability • Partner policies or terms • Any issues arising from services delivered directly by partners

Your use of BIGYES is also governed by our Privacy Policy, which explains what data we collect, how we use it, and how it is protected. By using the Application, you consent to the collection and processing of your information as described in the Privacy Policy.

Some features of BIGYES may require payment or a subscription. • All fees are stated clearly before purchase. • Purchases are processed through Apple or Google's payment systems. • Subscriptions automatically renew unless canceled according to store policies. • No refunds are provided except where required by law.

All content, branding, logos, design elements, and software associated with BIGYES are the exclusive property of BIGYES Developers and its licensors. Users receive a limited, non-exclusive, non-transferable license to use the Application.

BIGYES may suspend or terminate your access: • If you violate this Agreement • If required by law • If the Application is discontinued You may stop using the App at any time by deleting it from your device.

The Application is provided "as is" and "as available" without any warranties of any kind. BIGYES does not guarantee uninterrupted service, error-free functionality, or the accuracy of third-party content.

BIGYES is not liable for: • Indirect, incidental, or consequential damages • Loss of data or profits • Issues caused by partner hotels/cafés • User misconduct or misuse Where permitted by law, BIGYES's total liability shall not exceed the amount paid to BIGYES by the user in the last 12 months.

BIGYES may update this User Agreement at any time. Changes will be effective upon posting to the Application. Continued use means acceptance of the revised terms.

This Agreement is governed by the laws of Turkey, without regard to conflicts of law. Any disputes shall be resolved in the courts of Antalya, Turkey.
